Memorandum of Understanding
The memorandum of understanding (MoU) is a simplified instrument intended to register general principles that guide the relations between entities in the political, economic, cultural, scientific and educational levels. It represents the first step in formalization of more elaborated legal documents, as cooperation agreements.
Due to its simplified format, the MoU has been widely used to define the lines of action and the compromises of international cooperation. It is recommended that the Memorandum contains the following information:

Objective of cooperation, specifying the areas of interest;

Scope of cooperation;

Description of activities and rules for modifications;

Terms and conditions of the execution of the activities;

Responsibility for expenses;

Language;
-
Rules related to interpretation of the MoU;

Indication of professional contacts in each area of interest; and

Requirement of publication of the MoU in the Brazilian Union’s Official Journal and in corresponding publications of the countries.
The ANTT signed a Memorandum of Understanding with the European Railway Agency. ANTT also uses other agreements signed by Transport Ministry (currently Infrastructure Ministry) of Brazil with other countries such as United States, Netherlands, Germany and Spain, in order to keep cooperation. Besides that, there as other countries, such as China, which are informal partners of ANTT.
In some cases, ANTT attempted signing MoUs with foreign organizations but had difficulties due to them not being regulatory agencies and, thus, not considered as counterpart.
These MoUs serve as base to allow ANTT keeping in contact with regulatory practices, enforcement and inspections procedures and routine activities in other counties. In this way, the enhancement of ANTT´s regulatory actions involves the training of employees, which can be done by technical visits, seminars, exchange of experiences by meetings, documents or traineeships.
